Privacy Policy

This policy applies to this website and to any business interaction that follows from it (inquiries, call bookings, communications). It is written to comply with the law of Spain and the European Union (GDPR, LOPDGDD, and LSSICE) and with applicable United States law (CalOPPA and, to the extent applicable, CCPA/CPRA). We may update it as our tools or applicable law change; the date of the last update appears at the bottom of this page.

Data controller

The controller of personal data processed through this website is Closeup Marketing LLC, a limited liability company formed under the laws of the State of California, United States, registration number 202463318759 with the California Secretary of State, with its registered address at 2071 S Lowell St, Santa Ana, CA 92707, United States. You can reach us about anything related to this policy at hello@closeupmarketing.com.

Scope

This policy applies to anyone who visits this website, requests information about our services, or books a call with us, regardless of where they access it from. We pay particular attention to the rights of individuals in Spain and the European Union under the General Data Protection Regulation (GDPR) and Spain's Organic Law 3/2018 on Data Protection and the Guarantee of Digital Rights (LOPDGDD), and to the rights of individuals in California, United States, under the California Online Privacy Protection Act (CalOPPA) and, to the extent their thresholds apply, the California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA).

What information we collect

This site does not yet include any form of its own. The way to reach us is by email, our call-booking calendar, or by browsing with analytics cookies turned on (see below). When you email hello@closeupmarketing.com or book a call, we collect what you provide us: your name, email, phone number if you share one, and the content of your message or whatever the booking form asks for at that time.

Automatically collected information

This site uses Google Analytics and Google Tag Manager to measure visits and aggregate site usage, but they only turn on if you accept the cookie notice shown on your first visit; until you do, these scripts don't load and no cookie of this kind is set. Regardless of your choice, our hosting provider automatically logs basic technical data (IP address, browser type, pages visited) for security and service operation purposes, as any web infrastructure provider does. Embedded third-party video

Some pages on this site show videos hosted on Vimeo. When one of these videos loads, Vimeo, Inc. may receive your IP address and other technical data under its own privacy policy, available at vimeo.com/privacy, for which Closeup is not responsible. We don't autoplay audio on any video.

Purpose of processing

We use the information you give us to respond to your inquiry, assess whether our services are a fit for your business, manage booking and follow-up for a call, and, only if you opt in, send you marketing communications about our services.

Legal basis (users in Spain and the European Union)

We process your data to respond to your request on the basis of pre-contractual steps taken at your request (GDPR Article 6(1)(b)). When we send marketing communications, we rely on your consent (Article 6(1)(a)), which you can withdraw at any time without affecting the lawfulness of processing carried out before that withdrawal. Our hosting provider's basic technical logging relies on our legitimate interest in keeping the site running securely (Article 6(1)(f)).

Who we share your data with

We do not sell your personal information. We share it only with the vendors strictly necessary to deliver the service, such as our hosting and email providers. As we add further tools (a booking calendar, a CRM), they will be subject to this same policy and, where applicable, to a data processing agreement with that vendor under GDPR Article 28.

Closeup as a service provider for our clients

When we manage campaigns, forms, or a CRM on behalf of a Closeup client, we act as that client's service provider/processor, not as the controller. This policy does not govern those processing activities: they're governed by the service agreement signed with each client and, where applicable, by a separate data processing agreement. If you received a communication from a business that works with Closeup, the privacy policy that applies is that business's own.

International transfers

Closeup Marketing LLC is formed in the United States. Where processing your data involves a transfer from Spain or the European Union to the United States, we apply the safeguards required by Chapter V of the GDPR, in particular the European Commission's standard contractual clauses, together with reasonable supplementary technical and organizational measures, to ensure a level of protection equivalent to that of the European Economic Area.

Retention

We keep the data from a contact or inquiry for as long as there's an active or potential business relationship with you. Once that relationship ends, or if you request deletion, we delete or anonymize your data, unless applicable commercial, accounting, or tax law requires us to keep it for a further period (generally up to 6 years from the last interaction under Spain's Commercial Code, or the analogous period required under applicable US law).

Security

We apply reasonable technical and organizational measures to protect your data, appropriate to the volume and sensitivity of the information we handle. No system is completely invulnerable, and we cannot guarantee absolute security against incidents.

Your rights (Spain and the European Union)

Under the GDPR and LOPDGDD, you have the right to access your data, correct it, request its deletion, object to processing, request restriction, request data portability, and withdraw your consent at any time. You can exercise these rights by writing to hello@closeupmarketing.com, stating the right you wish to exercise and providing proof of identity. If you believe we haven't properly handled your request, you can file a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).

Your rights (California, United States)

Under CalOPPA, and under the CCPA/CPRA to the extent their thresholds apply to Closeup Marketing LLC, if you're a California resident you may have the right to know what data we hold about you, request its correction or deletion, opt out of the sale or sharing of your data, limit the use of sensitive information, and not be discriminated against for exercising these rights. We do not sell or share personal information for third-party advertising purposes.

"Do Not Track" signals and Global Privacy Control

This site does not yet automatically detect the browser's "Do Not Track" or Global Privacy Control signals. Instead, your choice on the cookie notice (accept or reject) is what determines whether analytics cookies turn on, and you can change it anytime by clearing this site's browsing data in your browser so the notice appears again.

Children

This site is directed at businesses and adults responsible for business decisions. We do not knowingly target any content at children under 13, nor do we knowingly collect data from children.

Changes to this policy

We may update this policy as our tools, our services, or applicable law change. We'll always indicate the date of the last update at the bottom of this page.
